At the beginning of the year, the Draft Common Frame of Reference (DCFR) was published. The text is the result of the work of a broad range of private law scholars from the Member States of the European Union, and it presents itself as an ‘academic’ document, committed to the precepts of scholarship rather than politics. Notwithstanding its unwieldy name, the text is nothing less than the draft of the central components of a European Civil Code. The following article aims (...) to inform the reader about this potentially important document and to initiate further academic debate about it. Following an overview of the genesis and content of the DCFR (Part 1), the discussion focuses on whether, and to what extent, it is based upon consistent and convincing core aims and values (Part 2). The article then proceeds to address, more specifically, the significance of private autonomy, and it examines the extent to which the proposed rules satisfy the requirements of legal certainty and legal clarity (Part 3). Thereafter, the DCFR is measured against the criteria of internal consistency and systematic integrity (Part 4). Also (Part 5) the question is asked whether the Draft critically reflects and convincingly integrates the sources on which it is based (that is the Lando Commission's Principles of European Contract Law and the Acquis Principles, as well as the private law traditions of the Member States). Also deserving of attention is the inclusion of more than 120 definitions of central concepts of private law, which are not to be found in this form or level of detail in either the Lando Principles or the national private laws (Part 6). Fifty years ago Hartman studied the barrier transmission time of wave packets (J Appl Phys 33:3427–3433, 1962). He was inspired by the tunneling experiments across thin insulating layers at that time. For opaque barriers he calculated faster than light propagation and a transmission time independent of barrier length, which is called the Hartman effect. A faster than light (FTL or superluminal) wave packet velocity was deduced in analog tunneling experiments with microwaves and with infrared light thirty years later. Recently, the (...) conjectured zero time of electron tunneling was claimed to have been observed in ionizing helium inside the barrier. The calculated and measured short tunneling time arises at the barrier front. This tunneling time was found to be universal for elastic fields as well as for electromagnetic fields. Remarkable is that the delay time is the same for the reflected and the transmitted waves in the case of symmetric barriers. Several theoretical physicists predicted this strange nature of the tunneling process. However, even with this background many members of the physics community do not accept a FTL signal velocity interpretation of the experimental tunneling results. Instead a luminal front velocity was calculated to explain the FTL experimental results frequently. However, Brillouin stated in his book on wave propagation and group velocity that the front velocity is given by the group velocity of wave packets in the case of physical signals, which have only finite frequency bandwidths. Some studies assumed barriers to be cavities and the observed tunneling time does represent the cavity lifetime. Seit dem byzantinischen Bilderstreit und dem Bildersturm der Reformation ist nicht mehr in solcher Intensität über Bilder nachgedacht worden wie in den letzten Jahrzehnten. Neben der Archäologie und der Kunstgeschichte haben sich zahlreiche weitere Fächer an Fragestellungen rund um das Bild geradezu festgebissen. Angesichts dessen geht einer der bedeutendsten Kunsthistoriker der Gegenwart der Frage nach, warum Begriff und Geltung sowie Macht und Ohnmacht von Bildern so hartnäckig verfolgte Themen unserer Tage geworden sind.

In the first part, the author characterizes the fundamental contents (principles) of the constitutional state. In the second part, he describes the necessary reforms both at the level of the national constitutional state and at the global and humanity level. In the third part, he examines the methods and procedures of reform in the constitutional state, analysing: a) constitutional formation or complete revision; b) constitutional amendments or partial revision; c) parliamentary constitutional legislation; d) constitutional interpretation; e) government and non‐governmental “outlook” (...) commissions. Providing sport psychology services to athletes and coaches before and during the Olympic Games presents a number of ethical concerns and challenges for the practitioner. These challenges are amplified by the nontraditional way in which sport psychology services are delivered, requiring careful attention to maintaining ethical behavior no matter the setting. The purpose of this article is, from the perspective of sport psychology consultants employed by the U.S. Olympic Committee, to outline specific challenges, including prolonged travel with teams, multiple relationships, (...) and such Olympic Games-related issues as dealing with the media, team identification, servicing multiple teams simultaneously, and practitioner self-care. Strategies for coping with these challenges, as well as questions to ponder, are also presented as a way to increase awareness of this field's unique challenges for the aspiring practitioner. In this book the author gives a broad overview of different areas of research in nonmonotonic reasoning, and presents some new results and ideas based on his research. The guiding principles are: clarification of the different research activities in the area, which have sometimes been undertaken independently of each other; and appreciation of the fact that these research activities often represent different means to the same ends, namely sound theoretical foundations and efficient computation. The book begins with a discussion of (...) the various types of nonmonotonic reasoning, their applications and their logics. Theorem proving techniques for these logics are also described. The following chapters deal with formulations of nonmonotonic inheritance, and nonmonotonic reasoning based on nonmonotonic rules. The final chapter discusses the achievements in the field in the light of the Yale shooting example. Die jetzt vorliegende ungekürzte Korrespondenz zwischen Sigmund Freud und Karl Abraham in originalem Deutsch erlaubt Einblicke in den wissenschaftlichen Austauschprozess bei der Entwicklung ihrer psychoanalytischen Konzepte. Abrahams einseitig-genetische Vorstellungen über die destruktiv-sadistischen Aspekte der Oralität und über die frühen Objektbeziehungen sind bei Freud auf Widerspruch gestoßen. Freud erweist sich einerseits als geduldiger Lehrer und Supervisor für Abraham. Andererseits ist er auch kritischer Mahner, der Abraham bis in die letzten Briefe daran erinnert, die Grundbedingungen der Neurosenentstehung zu beachten. Die Ergebnisse von (...) Abrahams klinischen Beobachtungen sind für Freud wiederum wertvolle Bestätigungen für seine eigenen Überlegungen zur Pathologie früher Störungen. Der Autor zeichnet die Entwicklung der unterschiedlichen Ansätze am wissenschaftlichen Briefwechsel nach. Der Akzent liegt auf dem ätiologischen Problem der Neurosengenese im kausalen Denken bzw. im Denken vor dem Hintergrund von Nachträglichkeit. Die weitere Entwicklung der Konzeptionen nach Abrahams Tod wird kurz skizziert. (shrink)

In his 1875 description of the language, Theodor Nöldeke describes Mandaic as among the purest of the Aramaic languages and the furthest from Western Aramaic, particularly with respect to its lexicon. As Mandæans identify their faith with that of John the Baptist and his community of followers, this observation is not without relevance for assessing the veracity of their accounts and reconstructing their history prior to the advent of Islam. Departing from the assumption that these accounts are either inaccurate or (...) willfully dishonest, all recent descriptions of the Mandaic language maintain that it is completely free from any western influences whatsoever, employing a considerably stronger form of Nöldeke’s original claim. This article subjects the strong form of this claim to a critical analysis, surveying the evidence for western influence upon the lexicon of the Mandæan scriptural canon, principally the Canonical Prayerbook, the Great Treasure, and the Mandæan Book of John. It finds that these works contain numerous lexemes of Hebrew, Greek, Latin, and Western Aramaic origin that are otherwise unparalleled within Eastern Aramaic, and concludes that the scholarly consensus must either be revised to account for this evidence or abandoned. Zusammenfassung In Deutschland verlangt das Transplantationsgesetz die Zuteilung von postmortal gespendeten Organen nach den Kriterien der Dringlichkeit und der Erfolgsaussicht. Der herrschenden Auffassung zufolge darf die Erfolgsaussicht hierbei jedoch lediglich den Charakter einer Minimalnutzenschwelle annehmen. Eine darüber hinausgehende Gewichtung von Erfolgsaussichten soll zudem nicht mit der Lebenswertindifferenzkonzeption des Bundesverfassungsgerichts zu vereinbaren sein, die aus dem Gleichheitsgrundsatz sowie aus der Menschenwürde abgeleitet wird. Gerhard Dannecker argumentiert, diese im juristischen Schrifttum überwiegend vertretene Auffassung sei weniger zwingend, als es auf den ersten (...) Blick scheinen mag. Seiner Auffassung zufolge lässt sich aus der Lebensschutzgarantie in Artikel 2 der Verfassung eine Pflicht ableiten, die vorhandenen Ressourcen möglichst effektiv einzusetzen. Zwar dürfe Effizienz hier tatsächlich nicht bedeuten, dass die Funktionsdauer der vorhandenen Organe über das Gesamtkollektiv aller Patienten hinweg utilitaristisch zu maximieren sei - eine Pflicht zur Rettung einer möglichst großen Anzahl an Menschen lässt sich ihres Erachtens jedoch durchaus rechtfertigen.
